No. All S Pass or Work Permit holders are not allowed to be registered as company directors or secretaries. In addition, they are also not allowed to be shareholders of a Singapore company. Therefore, they cannot be registered with ACRA as company directors, secretaries and/or shareholders.
If any S Pass or Work Permit holder does so, they would have contravened the conditions of their S Pass and Work Permit. They can have their passes revoked. In addition, they will also need to serve an employment ban.
Do note that the job title of “secretary” is different from being registered as a company secretary with ACRA. If an S Pass or Work Permit holder is employed as a secretary, that is not a contravention of the conditions of their S Pass or Work Permit.
If you have any S Pass or Work Permit-related queries, you may contact the corporate compliance team at [email protected].
Yours sincerely,
